Nasrallah and FRE 404(b)

Iranian television’s English service broadcast Hezbollah’s leader’s press conference last night with simultaneous translation. At the conference, Nasrallah made his case for Israel’s involvement in the assassination of Rafik Hariri.

Federal Rule of Evidence 404(b) permits the introduction of similar acts (not necessarily crimes) into evidence for consideration by the factfinder as being probative of guilt.

It occurred to me while watching Nasrallah, that he was acting less like a religious leader and more like a prosecutor. He presented a good deal of 404 (b) evidence showing Israel’s admitted complicity in another car bombing in 1993.

I am not in a position to opine as to whether Nasrallah made his case against Israel. But I can say that it sounded convincing and I have often seen American juries convict based on less evidence.
